How Can a 501(c)(3) Push for Social, Policy and Legal Reform?
As a 501(c)(3) tax-exempt organization, Unchained is allowed to engage in advocacy, without limits. “Advocacy” involves raising awareness of the need for legislative change, without taking a position on a specific bill or political candidate.
Unchained also is allowed to engage in some lobbying, with limits. “Lobbying” involves direct communication with a government official or the public to influence specific legislation. A 501(c)(3) must make sure lobbying is not a substantial part of its activities.
To ensure compliance with this rule, every year Unchained takes the 501(h) election. That means Unchained carefully tracks its lobbying-related expenditures and files Form 5768 with the IRS to confirm the organization’s lobbying activities are well within the limits allowed for a 501(c)(3).
